Gentlemen:
We are pleased to submit the following equipment and truck rental rates for your use, effective June 1, 2008. We will reserve the right to escalate all rates periodically.
All rates are Straight Time hourly rates (7:00 AM to 3:30 PM, Monday thru Friday) and include labor, maintenance and repair, taxes, fuel, oil and grease. Items noted (Bare) do not include operator or fuels.
For Premium Time work (hours other than above, including holidays) a charge to cover the cost of the operator’s additional wages and taxes shall be added to the quoted hourly rates. Added cost (mechanics, tire trucks, dump operators, etc.) will be negotiated at the time of the request for shift work and/or Saturdays and Sundays.
Transportation charges or travel time (men and/or equipment) will be additional. There will be a flat charge for delivery and pickup of small tools and/or unmanned small equipment.
Applicable Sales and Use Taxes and Permits will be additional.
There will be no charge whatsoever for down time due to breakdown or running repair. There will be no charge for down time due to adverse weather conditions except for the cost of the labor that is idled, since they are on an eight-hour guarantee per day. We must charge for idle or standby time due to causes beyond our control such as, but not limited to, the lessee’s scheduling or inadvertent shutdown.
Work tickets will be furnished daily in duplicate for signature and will form the basis for payment. It is understood that payment for rental equipment shall be made monthly, in full (no retainer), within forty-five (45) days after receipt of invoice and shall not be incorporated into any other existing agreement with Potts and Callahan, Inc. One percent (1%) interest may be accrued against late payments. Legal fees will also be charged, if necessary.
None of the following rates apply to contaminated or hazardous materials, snow, rock, masonry or other severe conditions of usage or shift work, except where noted.
Various other items of equipment and/or vehicles are available with prices upon request. All terms and conditions stated herein shall also apply to these rentals.
It is understood and agreed upon that all rented equipment is under the supervision, jurisdiction and control of the Lessee. By the act of renting, the Lessee thereby agrees to indemnify and hold Potts and Callahan, Inc. harmless from all expenses, liability and responsibility resulting from the Lessee’s use of said rented equipment.
Lessee further understands and affirmatively covenants to use due care and diligence to investigate the existence of any electrical, gas, water, sewer or other utility lines or encasements on the site at which Potts and Callahan, Inc.’s equipment will be used. It is acknowledged by Lessee that due to its complete care and control that Potts and Callahan, Inc. shall have no responsibility, whatsoever, whether to locate or investigate the existence of any utilities as above. In the event any utility lines or equipment are damaged by the rented equipment, manned or otherwise, Lessee agrees to bear the costs of repairing and paying for such damages and shall fully indemnify and hold harmless Potts and Callahan, Inc. from any claims or causes of action resulting there from.
With the usage of the rental equipment, the Lessee agrees to observe all applicable Laws and Ordinances including Standards prescribed by the Occupational Safety and Health Act and the U.S. Environmental Protection Agency, and agrees to indemnify and save harmless the Lessor from all citations, fines or other expenses incurred due to the Lessee’s violation of, or failure to comply with such Laws, Ordinances or Standards.
Trucks must be ordered by 2:00 PM for the following day at (410) 576-6772. Trucks may be canceled prior to 6:30 AM. Equipment must be ordered by 2:00 PM for the following day at (410) 576-6750.
Dumping fees for disposal of materials shall be quoted herein. Potts and Callahan, Inc. cannot receive any materials that are defined as “Hazardous” or “Contaminated” regardless of the volume. Any such unauthorized materials that may be transported in our trucks or deposited into our landfills are the sole responsibility of the Lessee.
Lessee agrees to use reasonable, diligent efforts to determine the existence of any “Hazardous” or “Contaminated” materials on the job where the equipment is to be used, disclosing the existence of either to Potts and Callahan, Inc. as soon as practicable. Upon such disclosure, Potts and Callahan, Inc. reserves the right to decline further rental in connection with handling of such materials. Lessee further understands and agrees it shall fully indemnify and hold harmless Potts and Callahan, Inc. in connection with any and all charges associated with the transportation, handling or disposal of such materials whether in the nature of fines (governmental or otherwise) or actual costs of cleanup or removal of unauthorized materials in our trucks or landfills.
Attached are the Billing Rates for Employees covered under the current Baltimore Highway and Commercial Excavation Wage Package. An additional charge will be applied to the wage rates when used on any Building Trade or Hazardous Material site.
